29.3The ApplyRight Terms of Use govern the use of the ApplyRight App. If they conflict with this Agreement in relation to the Services, this Agreement prevails.
30Third party rights
30.1Except as set out in clause 30.2, a person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.
30.2The Affiliates of the Company may enforce the provisions of this Agreement.
31Governing law and jurisdiction
31.1This Agreement and any dispute or claim arising out of or in connection with it, its subject matter or formation (including non-contractual disputes or claims) are governed by the laws of England and Wales.
31.2Subject to clause 17, the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement, its subject matter or formation (including non-contractual disputes or claims).
31.3For international Clients, the Parties may agree in writing, before any dispute arises, to submit disputes to the jurisdiction of another country or region.
32Electronic signature and acceptance
32.1By purchasing any services or packages on the website, the Client agrees to this Agreement. Clicking "I Agree" or a similar acceptance button during checkout is a valid electronic signature binding the Client to this Agreement, and no further formal signature is required. Where particular services require additional consent, the Client will be told and that consent will be obtained.
33Pausing your package
33.1The Client may pause the Services once during the engagement period by asking the Company in writing, including through the ApplyRight App.
33.2A pause may last up to six (6) months. While the Services are paused, the Company does not submit applications and the engagement period stops running. The remaining weeks resume when the Client asks to restart.
33.3If the Client does not restart the Services within six (6) months of the start of the pause, the remaining Services expire and no refund is due.
33.4A pause does not affect work already delivered, including the Client's CV and LinkedIn profile.
34Gift packages
34.1A package may be bought as a gift for another person (the Recipient). The buyer pays in full at the time of purchase and confirms that the Recipient would be happy to be contacted by the Company.
34.2The Company contacts the Recipient by email and on WhatsApp within one (1) Business Day of the order, using the details the buyer provides, and shares the buyer's note.
34.3The Recipient becomes the Client and accepts these Terms and Conditions when starting the Services. For a gift, the engagement period starts on the date of the Recipient's onboarding call, not the purchase date.
34.4A gift is valid for twelve (12) months from the purchase date. If the Recipient has not started the Services within that time, the gift expires.
34.5The buyer may cancel a gift within fourteen (14) days of purchase. If the Recipient has not yet had the onboarding call, the Company refunds the buyer in full. If the onboarding call has taken place, the Company refunds the buyer less a proportionate amount for the work already done. After the fourteen (14) days, gift packages are non-refundable in the same way as other packages under clause 6, except under the fit promise in clause 36, in which case the refund is paid to the buyer. This applies whether or not the Recipient takes up the gift, and if the gift expires unused.
34.6A gift may be passed to a different Recipient only with the Company's written consent and before the original Recipient's onboarding call.
34.7If the buyer asks for the tips they share about the Recipient to be kept private, the Company shares them only with the Recipient's career consultant.
35Free extension on Premium
35.1If a Client on the Premium package has had no interview by the end of the sixteen (16) week engagement period, the Company extends the Client's job search for a further sixteen (16) weeks free of charge, subject to this clause.
35.2In this clause, an interview means any call or meeting with an employer or a recruiter about a specific role, by phone, video or in person, including a first screening call.
35.3To qualify, the Client must have:
35.3.1provided the information requested and approved their CV and LinkedIn profile during the set-up week;
35.3.2responded to the Company's requests within the timeframes set out in clause 3.2;
35.3.3kept their job search brief in the ApplyRight App accurate and up to date; and
35.3.4not declined an interview invitation, or asked the Company to stop applying for roles that match their brief.
35.4The Client must request the free extension in writing, including through the ApplyRight App, within fourteen (14) days after the end of the engagement period.
35.5The free extension provides the full Premium package service again for sixteen (16) weeks, with all its features, including job applications in line with the Client's brief, interview preparation sessions, the direct approach to hiring managers and access to the ApplyRight App.
35.6The free extension is available once per package. It cannot be exchanged for a refund or transferred to another person. A gifted Premium package qualifies on the same terms.
36Our fit promise
36.1The Company only takes on job searches it believes it can move forward. At the onboarding call, the Company reviews the Client's experience, skills and qualifications against the roles the Client is targeting.
36.2If the Company decides that it cannot run an effective job search for the Client's target roles, it will tell the Client and refund the Fees in full. Where the package was bought as a gift, the refund is paid to the buyer.
36.3The decision under this clause is made by the Company alone, at or immediately after the onboarding call and before the set-up week begins. The Client cannot request a refund under this clause, and a change of mind is covered by clause 6.
36.4This clause does not apply if the Client does not attend the onboarding call, does not provide the information the Company requests, or has given false or incomplete information about their experience, skills or qualifications.
36.5This clause applies once per Client.
